STBAir Terms of Service

All clients are subject to the following terms of service which ensure our responsibility to protect each client and to provide the best services available:
1. INDEMNIFICATION POLICY
1.1
STBAir is a product suite incorporating various services ('The/a Service') and functions and which belongs exclusively to STBAir. The Service is designed to operate on Tizen, LG webOS, Roku, Android TV, and FireTV among other platforms.
1.2
Unless expressly permitted by law or per agreement, you may not copy, decompile, reverse engineer, disassemble, or attempt to derive the source code of, modify, or create derivative works of the Service. You may not remove, obscure, or alter any copyright notice or other proprietary rights notices affixed to or contained within the Service. You may not separate the component programs of the Service for use on different computers or sublicense, lease, rent, loan, or distribute the Service to any third party. STBAir will be entitled to immediately suspend and/or terminate service provision upon prima facie evidence of breach of this clause being attained.
1.3
The Service contains valuable intellectual property. You acknowledge and agree that the Service, including its sequence, structure, organization, source code and applicable documentation, contains valuable trade secrets and other intellectual property of STBAir. The Service is licensed and not sold to you, and no title or ownership to such Service or the intellectual property rights embodied therein is granted to you. You agree that any actual or threatened breach of these terms will constitute immediate, irreparable harm to STBAir for which monetary damages would be an inadequate remedy.
1.4
Components from third parties may be accessed or delivered along with the Service as a matter of course. STBAir shall not be responsible for any such Third-Party Service, and have no obligations or rights in respect thereof. You are solely responsible for independently investigating and ensuring that the device on which the Service is installed has all necessary third-party licenses as may be necessary for the streaming standards and/or DRM formats utilized. Supply of the Service does not convey a license nor imply any right to view or distribute content compliant with such streaming standards and/or DRM formats.
1.5
Your privacy is important to STBAir and we take the matters of protection and security of its users' information very seriously. You agree to indemnify and hold STBAir harmless against any cost, loss or damage arising out of your breach of this agreement.
1.6
You agree to use the STBAir service, including all features and functionalities associated therewith, in accordance with all applicable laws. We may terminate or restrict your use of our service if you violate these Terms of Service or are engaged in illegal or fraudulent use of the service.
1.7
The party who created the STBAir account is responsible for any activity that occurs through the STBAir account. We can terminate your account or place your account on hold in order to protect you, STBAir or our partners from identity theft or other fraudulent activity.
2. BILLING
2.1
At this time we provide 3-days Trials, bill monthly, bi-annually, or yearly, depending upon the license you have chosen. To the extent permitted by the applicable law, payments are non-refundable and we do not provide refunds or credits, for any reason whatsoever.
2.3
There are no contract periods but for each successive period, your contract is automatically renewed unless we are notified otherwise.
2.4
In case of payment disputes, transaction reversals or payment fraud, we reserve the right to block the app from being used for the device the license was intended to.
2.5
Cancelations must be requested in no less than 48 hours before the invoice's due date otherwise further non-refundable changes for the next period may occur.
3. LATE PAYMENTS
3.1
All accounts are billed according to the dates they were first activated on. If your payment is not cleared in 2 days after due-date, your account will be suspended.
3.2
If you do not resume your service in less than 3 months after deactivation, your account will be terminated and all app settings including Portals will be lost.
3.3
Upon license suspension we may preserve the data for the license for up to 3 months. However upon license termination all data associated with that license is destroyed.
4. ACCEPTABLE USE POLICY
4.1
All services provided by STBAir may be used for lawful purposes only. This includes, but is not limited to: viewing and storing copyrighted material, material we judge to be threatening or obscene, or material protected by trade secret and other statute.
4.2
The subscriber agrees to indemnify and hold harmless STBAir and its employees from any claims resulting from the use of the service which damages the subscriber or any other party.
4.3
Our acceptable use policy is actively and strictly enforced. Offending content or users are suspended from our network, usually as soon as they are discovered.
4.4
Changing MAC address or device ID to circumvent licensing requires purchasing a new license or contacting support for authorized transfers.
4.5
Subscriber acknowledges that the service provided is of such a nature that service can be interrupted for many reasons other than the negligence of the company and that damages resulting from any interruption of service are difficult to ascertain. Therefore, subscriber agrees that the company shall not be liable for any damages arising from such causes beyond the direct and exclusive control of the company.
4.7
Illegality In any form, including but not limited to the unauthorized viewing, distribution or copying of copyrighted material or other data, harassment, fraud, trafficking in obscene material, is not permitted on our network.
5. LIMITATION OF LIABILITY
5.1
The STBAir service is provided "as is" and without warranty or condition. In particular, our service may not be uninterrupted or error-free. You waive all special, indirect and consequential damages against us.
5.2
Where permitted under the applicable law, you and STBAir agree that each may bring claims against the other only in your or its individual capacity, and not as a plaintiff or class member in any purported class or representative proceeding.
6. DISCLAIMER
6.1
STBAir cannot be held liable for system downtime, crashes, or data loss. We cannot be held liable for any predicted estimate of profits in which a client would have gained if their app was functioning.
6.3
You must ensure that all authorised users that access or use the STBAir Service through your STBAir Account, are aware of these STBAir Terms, agree to these STBAir Terms, and comply with these STBAir Terms.
6.15
In order to access and use the STBAir Service, your access devices must meet the minimum technical specifications. We will not be responsible for your inability to access the STBAir Service due to limitations specific to your access devices.
6.23
The STBAir Service may only be used by you in a lawful manner in the way that we specifically intended and for your personal and non-commercial purposes.
6.24
You must not, directly or indirectly, do any of the following things or allow anybody else to do so: perform any action that violates any of these STBAir Terms or any guidelines or policies posted by us; display, distribute, communicate, transmit, publish or broadcast the STBAir Service or the content to the public; perform any action which is illegal, fraudulent or violates or infringes any Intellectual Property Rights of STBAir or that of any other party through use of our Service.
6.28
We may end this agreement and terminate your use of the STBAir Service and its functionalities immediately at any time for violations of these terms.
6.38
We reserve the right, at any time and from time to time, to amend or to modify these Terms and Conditions of Service and/or End User License Agreement without prior notice to you and your continued use shall confirm your acknowledgement and consent regarding such changes.
